Terms of Service

These Terms of Service ("Terms") govern your use of the FreshAlert website, device, and app (the "Services"). By using the Services or signing up for early access, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. If you're signing up on behalf of a household, you confirm you're authorized to do so.

2. Early access & pre-launch

FreshAlert is in pre-launch. Signing up for early access adds you to our waiting list and grants the benefits described on the early-access page (e.g., one free month at launch). Benefits are contingent on the product actually launching and on you completing onboarding. We may change or withdraw early-access perks with notice.

3. Your account

You're responsible for the accuracy of the information you give us (e.g., your email) and for any activity that happens under your account. Tell us promptly if you believe your account has been compromised.

4. Food-safety disclaimer

FreshAlert is a helper, not a replacement for your own judgment.

  • Recall data is sourced from public FDA/USDA feeds. Those feeds can be delayed, incomplete, or corrected after the fact. We make no guarantee that every recall will be surfaced.
  • Expiry predictions are estimates based on product metadata and typical shelf-life. Always trust your own senses, if something looks, smells, or tastes wrong, throw it out.
  • FreshAlert is not a medical device and does not diagnose, treat, or prevent any disease.

5. Acceptable use

You agree not to:

  • Reverse-engineer, tamper with, or resell the FreshAlert hardware or software.
  • Use the Services to break any law or harm anyone.
  • Upload false, infringing, or abusive content via our forms or support channels.
  • Attempt to access accounts or data that aren't yours.

6. Intellectual property

The FreshAlert name, logo, device design, software, and site content are owned by FreshAlert Inc. You get a limited, non-exclusive, non-transferable license to use the Services for personal, household use. Everything else is reserved.

7. Payments & subscriptions

Detailed billing terms (pricing, renewal, cancellation, refunds) will be presented at checkout once paid subscriptions go live. Early-access signups do not create any payment obligation.

8. Termination

You can stop using the Services and unsubscribe at any time. We may suspend or terminate accounts that violate these Terms.

9. Warranties & liability

The Services are provided "as is" without warranties of any kind, to the maximum extent permitted by law. To the fullest extent allowed, FreshAlert's total liability for any claim related to the Services will not exceed the greater of (a) amounts you paid us in the 12 months before the claim, or (b) USD $50.

10. Governing law & disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in San Francisco County, California, and you and we consent to jurisdiction there.

11. Changes

We may update these Terms. Material changes will be announced via email or on the site before they take effect. Continued use after the effective date means you accept the updates.
